Some advice from the Sheikh Muhammad `Ali Farkûs
 and his website administration
to those who are in authority
concerning the administrative procedures regarding
the biometric passport and identity card

All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.

Allah عزَّ وجلَّ ordained to abide by His religion and called people to come into submission (unto Him), He عزَّ وجلَّ said:

﴿يَا أَيُّهَا الَّذِينَ آمَنُوا ادْخُلُوا فِي السِّلْمِ كَافَّةً﴾ [البقرة: 208].

The meaning of the verse:

O you who believe! Enter perfectly in Islâm (by obeying all the rules and regulations of the Islâmic religion)﴿ [Al-Baqara (The Cow): 208].

He عزَّ وجلَّ ordered to obey Him and His Messenger صلَّى الله عليه وسلَّم absolutely by saying:

﴿وَأَطِيعُوا اللهَ وَالرَّسُولَ لَعَلَّكُمْ تُرْحَمُونَ﴾ [آل عمران: 132].

The meaning of the verse:

And obey Allâh and the Messenger (Muhammad صلَّى الله عليه وسلَّم) that you may obtain mercy.﴿ [Al-`imrân (The Family of Imrân): 132].

In response to this legal call and in order to do what Allah عزَّ وجلَّ obliged us to, namely, show the truth and advise people, the Sheikh Muhammad  ̀Ali Farkûs and his website administration team, though they understand the administrative procedures regarding the biometric passport and identity card, which aim is to restore security and restrain the ways of criminality, falsification and corruption, they do not approve of what the official authorities want to impose, that is to say, reduce the length of the man's beard and reveal the hair and ears of the woman in the photograph, as this decision goes against the verse of veil. Allah's عزَّ وجلَّ said:

﴿يَا أَيُّهَا النَّبِيُّ قُلْ لِأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاء الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلاَبِيبِهِنَّ ذَلِكَ أَدْنَى أَن يُعْرَفْنَ فَلاَ يُؤْذَيْنَ وَكَانَ اللهُ غَفُورًا رَحِيمًا﴾ [الأحزاب: 59].

The meaning of the verse:

O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e.screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed. And Allâh is Ever Oft­Forgiving, Most Merciful﴿ [Al-Ahzâb (The Confederates): 59].

He عزَّ وجلَّ also said:

﴿وَقُلْ لِلْمُؤْمِنَاتِ يَغْضُضْنَ مِنْ أَبْصَارِهِنَّ وَيَحْفَظْنَ فُرُوجَهُنَّ وَلاَ يُبْدِينَ زِينَتَهُنَّ إِلاَّ مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ﴾ [النور: 31].

The meaning of the verse:

And tell the believing women to lower their gaze (from looking at forbidden things), and protect their private parts (from illegal sexual acts, etc.) and not to show off their adornment except only that which is apparent (like palms of hands or one eye or both eyes for necessity to see the way, or outer dress like veil, gloves, head-cover, apron, etc.), and to draw their veils all over Juyubihinna (i.e. their bodies, faces, necks and bosoms, etc.)﴿ [An-Nûr (The Light): 31].

The scholars agreed all that what is considered by the sharia a `Aura(1) of the woman's body should be absolutely screened from others than relatives whether it is her real body or a photograph of her. It is not permissible for a woman to reveal her adornment except what is allowed by the sharia as in Allah's عزَّ وجلَّ saying:

﴿وَلاَ يُبْدِينَ زِينَتَهُنَّ إِلاَّ لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاء بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاء بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الإِرْبَةِ مِنَ الرِّجَالِ أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَى عَوْرَاتِ النِّسَاءِ وَلاَ يَضْرِبْنَ بِأَرْجُلِهِنَّ لِيُعْلَمَ مَا يُخْفِينَ مِن زِينَتِهِنَّ وَتُوبُوا إِلَى اللهِ جَمِيعاً أَيُّهَا الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَ﴾ [النور : 31].

The meaning of the verse:

…and not to reveal their adornment except to their husbands, their fathers, their husband's fathers, their sons, their husband's sons, their brothers or their brother's sons, or their sister's sons, or their (Muslim) women (i.e. their sisters in Islâm), or the (female) slaves whom their right hands possess, or old male servants who lack vigour, or small children who have no sense of the shame of sex. And let them not stamp their feet so as to reveal what they hide of their adornment. And all of you beg Allâh to forgive you all, O believers, that you may be successful.﴿ [An-Nûr (The Light): 31].

Knowing that the beard and the veil do not –definitely- contradict the determination of the face's features which is required for the photograph, as this does –not at all- hinder the ways of investigation and identification, and it is how many non-Muslim countries proceed out of respect for the religious rites and individual liberties.

The Sheikh Muhammad  ̀Ali Farkûs and his website administration team exhort the issuers of this decision to refrain from contradicting the sharia of Allah and what dishonors the dignity of the woman. Moreover, they do not approve of the fact of taking such decision as a means in such a way that the Algerian people leaves its originality, upright religion, Arabian identity and faith that the opponents of Islam and Arabian identity want to wipe out; Ibn Bâdis -رحمه الله- said:

The Algerian people is Muslim   

Affiliated to the Arabian identity

Whoever says it deviated from its origin 

Or it is dead, is certainly a liar

On the other side, they are opposed – totally - to cursing and blaspheming the rulers and all that lead to tribulations and dissidences that Algeria has suffered from for a decade.

We ask Allah عزَّ وجلَّ the Most High and the Most Powerful to grant the Muslim rulers success and guide them to good in life and in the hereafter, and to bestow upon them a righteous retinue who will help them well manage the affairs, and to show us and them the truth and help us to follow it, and show us the evil and how to avoid it.

The perfect knowledge belongs to Allah. Our last prayer is all praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon our Prophet, his Family, his Companions and Brothers till the Day of Resurrection.
