The ruling concerning the money paid
for the worker who has nothing
to work without any negligence from his side

Question:

I am a young holder of the Bachelor’s Degree in Accounting -praise is due to Allah- and I have benefited from the program of integrating young men by the Employment Agency –in my province- to work for a private civil engineering contractor while the State assures my monthly payment during a year according to the contract that was concluded. However, I am very concerned at the fact that the employer (the private contractor) no longer needs my services and told me that he is currently not in need despite the fact that I insisted on working. He affirmed that he will contact me whenever there is a need (of my services), but apparently, he will not and never contact me. With this in mind, the first months have already been paid into my postal account while I am unemployed, but from time to time I work as a painter to earn my livings. Today, I am very concerned at the [religious] legitimacy of these payments. Knowing that I am in a great need of this money. Give us the fatwa regarding this issue, and may Allah reward you and protect you.

 

Answer:

All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers until the Day of Resurrection:

It is incumbent upon the beneficiary to declare his case to the authority responsible for paying him for a period of a year in his province forasmuch as it is the owner of the money and responsible thereof. So, if this authority permitted it (the money) for him in the way that is mentioned in the question, then -in this case- it is permissible for him to benefit from the money, even though he does not do any work without his will. Otherwise, the responsible authority has to orientate him to achieving the [religious] permissible way of earning.

The perfect knowledge belongs to Allah عزَّ وجلَّ; and our last prayer is all the praises and thanks are to Allah, the Lord of the Worlds, and prayers of Allah are to Muhammad and his Family, Companions and Brothers until the Day of Resurrection.
